    The Mining Regulation (first enacted with Stb.538, 1964) is herewith amended to conform with the European Union's Guidelines that were established by the Council of the EU on 22 June 1994 (PbEG L 216).     The Privatization Act ("RBB") is applied here for the Minister of Justice to establish a limited private company which will become the privatized managing enterprise of the National Occupational Health and Occupational Safety Services. This is in coordination with the privatization of several government services which previously were administered by the public service sector. Affected are other national public services such as the Foundation Pension Fund ("ABP") and the Conditions of Employment Act. This new private enterprise will be called "RBB" which stands for National Occupational Health and Occupational Safety Service.

This follows from the decree of 4 October 1995 (Stb. 516 of the Netherlands) concerning the timeframe of entry into force of the decree of 1 September 1995, concerning amendments of the Fishing Vessel Decree in connection with the Guidelines No.93/103/EG of the Council of the European Community of 23 November 1993 (Pb.EG L 307) (Stb.456). This Publicatieblad (Pb) follows the most recent amendment to the Fishing Vessel Decree which is published in Pb. No.66 of the same date as the above.

    Concerns the safety and health of employees in the mining exploitation industry and brings amendments to the Mining Regulation ("Mr64") (Stb.538, 1964) and the Mining Regulation Continental Plate/Shelf ("Mrcp") (Stb.83, 1983; both last amended in Stb.164, 1995-03-22). The present amendments follow those of 1992-11-02 and of 1989-06-12 and adjust minimum safety and health regulations according to European Union laws.

    Decree of 4 November 1994 to amend the Mine Regulation 1964 and the Mine (Continental Shelf) Regulation (stronghold of mining installations, helicopter decks and radio diaries).

    Amends article 36d of the Mine Regulation 1964, in order to bring it in conformity with the Mine (Continental Shelf) Regulation, by providing that an undertaking which is making use of mining installations needs an official certificate stating that installations are meeting the stronghold requirements and that installations have to be subjected to regular inspection. Inserts new articles 36ja and 36jb to the Mine Regulation 1964 and articles 40a and 40b to the Mine (Continental Shelf) Regulation. Those articles contain security requirements on the use of helicopters for transportation from and to mining installations and on the use of helicopter decks. Lays the obligation upon the concerned undertakings to keep a radio diary on mining installations.

    Provides that employers must supply a safety and health document inter alia taking stock of and evaluating risks.     Decree of 17 May 1994 to lay down minimum instructions for the protection of employees against the dangers of exposure to biological agents at work (Decree on biological agents).

    Provides that employers must take stock of and evaluate the dangers linked to exposure to biological agents. The employer further must take preventive measures in order to limit the danger of exposure, i.e. keep a register of all employees working with dangerous agents, or give employees the opportunity to undergo a medical examination. Lays the obligations on the employer to notify the Service for Inspection and Information that work is performed with biological agents.

    Implements EC Directive 82/605/EEC concerning the protection of employees against the risks of exposure to metallic lead and its ion combinations at work. Declares the Lead Decree equally applicable to the mining industry.

    Decree of 2 May 1994 to lay down instructions to promote the improvment of the occupational safety and health of women workers during pregnancy and breast feeding (Decree on pregnant women workers).

    Implements articles 4 to 6 of EC Directive No. 92/85/EEC. Requires that the employer organizes labour, fix up the working place, adapts the production or working methods so that the safety and health of the pregnant or breast-feedig woman worker are not endangered. Should the fulfilment of this obligation not be possible, the temporary following measures shall be taken: adaptation of labour or working and rest periods; or asignment of other duties; or exemption from work. The employer shall take stock of and evaluate the hazards related to labour performed by the woman worker. Inserts a new article in the Lead Decree providing that pregnant or breast-feeding women worker shall not be compelled to perform labour where they might be exposed to lead or lead derivates.
