OBLIGATIONS OF RECEIVING STATES
5. Intensify efforts to protect the fundamental human rights, promote the welfare and uphold human dignity of migrant workers;
6. Work towards the achievement of harmony and tolerance between receiving states and migrant workers;
7. Facilitate access to resources and remedies through information, training and education, access to justice, and social welfare services as appropriate and in accordance with the legislation of the receiving state, provided that they fulfill the requirements under applicable laws, regulations and policies of the said state, bilateral agreements and multilateral treaties;
8. Promote fair and appropriate employment protection, payment of wages, and adequate access to decent working and living conditions for migrant workers;
9. Provide migrant workers, who may be victims of discrimination, abuse, exploitation, violence, with adequate access to the legal and judicial system of the
receiving states; and
10. Facilitate the exercise of consular functions to consular or diplomatic authorities of states of origin when a migrant worker is arrested or committed to prison or custody or detained in any other manner, under the laws and regulations of the receiving state and in accordance with the Vienna Convention on Consular Relations.
OBLIGATIONS OF SENDING STATES
11. Enhance measures related to the promotion and protection of the rights of migrant workers;
12. Ensure access to employment and livelihood opportunities for their citizens as sustainable alternatives to migration of workers;
13. Set up policies and procedures to facilitate aspects of migration of workers, including recruitment, preparation for deployment overseas and protection of the migrant workers when abroad as well as repatriation and reintegration to the countries of origin; and
14. Establish and promote legal practices to regulate recruitment of migrant workers and adopt mechanisms to eliminate recruitment malpractices through legal and valid
contracts, regulation and accreditation of recruitment agencies and employers, and blacklisting of negligent/unlawful agencies.

Directive No. (2/98) on Minimum hygiene conditions for on board fishing vessels. - Adoption: 1998-08-03 | MMR-1998-M-87419 The Directive contains two Annexes dealing with the hygienic requirements to comply with when handling and preserving fish products for a period exceeding 24 hours. Storage conditions must prevent any contamination either by fuel, dirt, heat or any other contaminating agent; water used for washing fish must be fresh (as per Directive 5/98) or clean seawater. If not maintained alive, fish must be cold-treated or unloaded in eight-hour time. All scaling and gutting procedures must be operated in clean areas and all non edible wastes kept separated from the edible ones and the latter refrigerated or frozen right after. All fishing vessels proceeding to freeze or chill the fish products, must be equipped with adequate and effective equipments and, in case of chilling, either by cooled seawater (CSW) or refrigerated seawater (RSW), all the tanks must be adequately filled and provided with working sewage. In every freezing or refrigerating facility a temperature sensor device must be present and in working conditions at all times and temperature charts available to inspecting authorities.

Atomic Energy Law (No. 8/98). - Adoption: 1998-06-08 | MMR-1998-L-87420 The aims of this Law are to develop the use of atomic energy, to ensure safety in using atomic energy, to carry out measures for the prevention of atomic radiation effects on man and on the environment, and to exchange information with foreign research institutes on knowledge and technology related to atomic energy. The Law consists of 14 Chapters divided into 39 sections.
The Ministry shall establish an Atomic Energy Council, which shall be formed by Ministers, Heads of Government Departments, Scientists, etc. Chapters IV to VI provide for duties and functions of the Ministers and of the Departments. Any individual in possession of any kind of nuclear or radioactive material shall apply to the Department for a registration certificate (Chapter VII). In case the individual shall utilize, produce, store, distribute or sell nuclear or radioactive material, a licence shall be obtained by the Department (Chapter VIII). For the import or export of any nuclear or radioactive material, the Government Department or Organization shall issue a licence or import-export permit (Chapter IX). The remaining Chapters contain administrative proceedings, prohibitions, penalties and provisions of miscellaneous nature.

Law Protecting the Peaceful and Systematic Transfer of State Responsibility and the Successful Performance of the Functions of the National Convention against Disturbances and Oppositions (SLORC Law No. 5/96) - Adoption: 1996-06-07 | MMR-1996-L-79570 Provides that "no one and no organization shall violate either directly or indirectly any of the following prohibitions:
(a) inciting, demonstrating, delivering speeches, making oral or written statements and disseminating in order to undermine the stability of the State, community peace and tranquility and prevalence of law and order;
(b) inciting, delivering speeches, making oral or written statements and disseminating in order to undermine national re consolidation;
(c) disturbing, destroying, obstructing, inciting, delivering speeches, making oral or written statements and disseminating in order to undermine, belittle and make people misunderstand the functions being carried out by the National Convention for the emergence of a firm and enduring Constitution;
(d) carrying out the functions of the National Convention or drafting and disseminating the Constitution of the State without lawful authorization;
(e) attempting or abetting the violation of any of the prohibitions." (Article 3)
Penalities for violation of the law include imprisonment for a minimum of 5 years and fines.

Comprehensive legislation on maintenance of discipline. Chapter II regulates submission of grievances by members of police force who deem themselves wronged by superior officer. Chapter III provides for administrative power of Police Director General. Chapter IV deals with arrest and custody of member of police force who is charged with offence. Chapter V makes provision for different types of offences. Chapter VI deals with summary trial if offence is not serious enough to be tried by Police Court. Chapter VII regulates powers and procedures of Police Court. Chapter VIII deals with execution of sentences, Chapter IX with procedure to be followed by Police Courts, Chapter X with confirmation and revision, and Chapter XI with appeal.

Private Industrial Enterprise Law (Law No. 22/1990). - Adoption: 1990-11-26 | MMR-1990-L-55215 Governs the registration of private industrial enterprises. Chapter One sets definitions for use with the act. Chapter sets the law's basic principles. These include inter alia, to increase national production and GNP, to acquire technical know-how and to create employment. Chapter Three establishes the procedures and manner of registration of private industrial enterprises. Chapter Four establishes the Private Enterprise Coordination Body, which is designed to coordinate the development and improvement of private industrial enterprises. Part Five creates a Supervisory Body for the function of recommending the registration of enterprises and supervising the compliance of enterprises with the laws of Myanmar. Establishes that the body is to recommend registration of enterprises on the basis of inter alia, not being injurious to the health of the public in the vicinity of the enterprise, not causing harm to the health of its workers and not coausing harm to the local environment. Chapter Six sets the duties and rights of entrepreneurs. Chapter Seven establishes the powers of the Director General of the Directorate of Regional Industrial Coordination and Industrial Inspection. Chapter Eight establishes the powers of the State or Divisional Officer-in-Charge. Chapter Nine makes explicit the conditions under which registration may be invalidated. Chapter Ten sets appeal procedures in case of such invalidation. Chapter Eleven establishes the powers of the Minister of No. 1 Industry with respect to the act. Chapter Twelve establishes acts by enterprises which are to be prohibited and Chapter Thirteen sets the penalties for such offences. Chapter Fourteen sets miscellaneous provisions including granting the Ministry of No. 1 Industry with the power to make regulations for the purposes of carrying out the act.
