Establece los presupuestos de responsabilidad, inclusive en caso de subcontratación e intermediación. Define el accidente "in itinere", la acción contra terceros. Los empleadores podrán sustituir total o parcialmente las obligaciones emergentes de la ley por un seguro constituido a favor del trabajador y sus causahabientes en entes aseguradores habilitados por la autoridad competente. Se prevén los eximientes de responsabilidad del empleador y del asegurador. Se establecen las modalidades de las indemnizaciones, de la asistencia médica y farmacéutica y su forma de pago. Se establecen plazos de prescripción para las acciones dimanentes de la ley, la protección de los derechos adquiridos por los trabajadores en función de la misma y un fondo de garantía para el pago de las prestaciones por accidentes de trabajo. Se deroga la ley nacional núm. 9688, de 11 de octubre de 1915, sobre accidentes del trabajo y enfermedades profesionales (Serie Legislativa, 1957-Arg.1-C). Hasta tanto se dicte el decreto reglamentario de la ley núm. 24028, "mantiénese la vigencia de las normas complementarias y reglamentarias de la ley núm. 9688 en cuanto resulten compatibles con la presente".
