Establece que queda autorizada la compatibilidad entre la actividad del discapacitado, en cualquier forma pública o privada, con la pensión por invalidez y que la jubilación común generada por dicha actividad del discapacitado será también compatible con dicha pensión.

La ley comprende definiciones, enumera políticas especiales, y establece medidas sociales y en el campo de la salud, educación, trabajo, arquitectura y urbanismo, transporte, y normas tributarias tendentes a la rehabilitación profesional y empleo de las personas inválidas. Se crea una comisión nacional honoraria del discapacitado.

Amends Law on the Employment of the Population introducing wording changes to articles 2 (employment of the population), 3 (recognition as unemployed), 4 (appropriate job), 7 (additional guarantees of job placement for certain categories of population), 10 (right to job placement), 13 (labor activity of the citizens of the Republic of Uzbekistan out of the country and the labor activity of foreign citizens in the Republic of Uzbekistan), 16 (competencies of the Ministry of Labor and Social Protection of the Population and its local bodies in the field of employment), also minor changes to articles 17, 18, 22, 27.
Amends Code of Administrative Responsibilities supplementing article 47 (failure to fulfill the duties of upbringing and educating) with a new part, rephrasing article 50 (violation of the legislation on the employment of the population), supplementing it with the new articles 51 (1) (violation of the legislation on the social protection of the disabled), 179 (4) (violation of the legislation on stock activity) changing the wording of article 99 (violation of the legislation on city construction), introducing minor wording changes, inter alia, to articles 100, 101, 165, 174 (1), 175; amends also Labor Code changing the wording of articles 60 (recognition as unemployed), 68 (additional guarantees for job placement to certain categories of population), supplementing Code with a new article 247 (1) (additional guarantees for the graduates of educational institutions), also introducing minor changes to articles 63, 65, 72, 84, 90, 107, 119, 149, 150, 160, 258, repealing articles 251, 252.

Tiene por objeto desarrollar los medios y mecanismos que garanticen el desarrollo integral de las personas con discapacidad de manera plena y autónoma, de acuerdo con sus capacidades, y lograr la integración a la vida familiar y comunitaria, mediante su participación directa como ciudadanos y ciudadanos plenos de derechos y la participación solidaria de la sociedad y la familia.
El Capítulo III (artículos 26-30) del Título II se refiere al trabajo y la capacitación, en especial a políticas laborales, formación para el trabajo, empleo para personas con discapacidad, empleo con apoyo integral e inserción y reinserción laboral.
El Título III contempla en Sistema Nacional de Atención integral a las personas con discapacidad.

Venezuela (Bolivarian Republic of) - Disabled workers - Law, Act

Ley para la integración de personas incapacitadas

Se establece el Consejo Nacional para la integración de las personas incapacitadas. El Título III de la ley trata de la integración social de las personas incapacitadas: gozan del pleno ejercicio de sus derechos, tienen acceso a la educación, a la salud (equipos y prótesis que faciliten su integración), derecho a la asistencia y libre acceso a los servicios e instalaciones de uso público. Los artículos 23 a 25 tratan del derecho al trabajo y el artículo 25 dispone que las empresas públicas o privadas que empleen más de 50 trabajadores tienen la obligación de emplear un mínimo de dos por ciento de incapacitados, siempre que los trabajadores incapacitados reúnan las condiciones de aptitud y capacitación laboral necesarias para el ejercicio de los cargos ofertados.

To qualify, vocational training programmes must have at least 70 per cent permanent enrollment of disabled persons, and enterprises must hire a specified proportion of disabled workers and include a disabled person in management. Stipulates that cities and provinces establish job funds to finance job training programmes and enterprises for the disabled. Also sets forth entitlements of disabled workers, types of enterprises which must accept a proportion of disabled workers, and stipulates that enterprises which have not hired prescribed proportions of disabled workers pay an indemnity to the Fund for Job Creation.

This Act provides for the welfare and rehabilitation of disabled persons, the appointment and functions of a Director for Disabled Persons' Affairs, and the establishment and functions of a National Disability Board.
