    Permits foreign-owned businesses to establish voluntary associations. Such associations may be established by a community of at least 30 businesses of the same nationality.

    Decree No. 58-CP of May 31, 1997 on the Wage Payment and Settlement of other interests for on-strike labourers.

    The determination of wages and settlement of other interests of employees for the days they are on strike shall be based on the Court's decision whether a strike is legal or not. In the event of a legal strike in which the employer is at fault, wages shall be covered in full by the employer. If the employer is not at fault, wages shall be negotiated and agreed upon by the executive committee of the local trade union and the employer. If the strike is illegal and the employer is at fault, wages shall be covered between 50-70 per cent by the employer. If the employer is not at fault, no wages shall be due for workers participating in an illegal strike.

    Sets forth criteria for inclusion of an enterprise on a list of enterprises which shall be prohibited from going on strike. Enterprises which shall not go on strike include those for which the State provides capital or holds prevailing shares, enterprises which produce products for the military, and public utility companies providing services which, if suspended due to a strike, would cause hardship for more that 30 per cent of the population of a city or industrial area. Implements section 3 of Decree No. 51-CP of 29 August 1996.

    Circular No. 10-LDTBXH/TT providing guidance on the organization and operation of the grassroots reconciliation council and the labour offices of districts, cities, towns and townships of the provinces and cities directly under the central government.

    Requires enterprises with more than 10 employees to set up Grassroots Labor Reconciliation Councils. Foreign enterprises are excluded for this requirement. The Council shall comprise an equal number of representatives from employer and employees, and shall be charged with settling collective and individual labour disputes, including matters related to termination of employment. Also provides for the appointment of a labour reconciliator at the district level to settle labour disputes in enterprises with fewer than 10 employees.

Repeals and replaces rules 23 and 24 concerning the return of the case record and mediator's report to the mediation officer at the close of mediation or in the case where mediation fails. A small amendment is made to Rule 26(3) by the deletion of the phrase "as may be thought reasonable by the mediator" and insertion of the phrase "not exceeding thirty days". Rules 25 and 29 are repealed.

    Defines "workers' organisation" in the regulations as a trade union, staff association or worker's committee as defined by the Labour Relations Act. Workers' and employers' organisations shall enjoy adequate protection against any acts of interference by each other or each other's agents or members in their establishment, functioning or administration. No employer or employers' organisation shall interfere with a workers' organisation or its agents or members with respect to the establishment, functioning or administration of the workers' organisation.
    It shall be considered an act of interference for an employer or employers' organisation to promote or finance a workers' organisation under the domination of the employer. Offenders against the regulation shall be liable to a fine or imprisonment.

Defines "unlawful collective action" as a strike, boycott, lockout, sit-in, stay-away or other action which is prohibited by subsection 104(3) of the Labour Relations Act or which resists the law of the government or seeks to induce or compell the government to alter a law. Allows the Labour Minister to suspend the registration of trade unions, employers' organizations, or federations which are associated with unlawful collective actions, provided reasonable opportunity is given for such organizations to make representations in the matter. Provides additional penalties for employers, officials of workers' and employers' organizations, and other persons who associate themselves with unlawful collective action. S. 7 provides for civil liability for persons or organizations which encourage or organize unlawful actions. S. 8 allows employers to dismiss employees without approval of the Minister on the grounds of participation in an unlawful action.

S.I. 371 sets forth, in accordance with s. 17 of the Act, the circumstances under which an employer may terminate a contract of employment. Where employers believe they have good cause, they may suspend an employee without pay and apply to a labour relations officer to seek termination of the contract. The Regulations further require prior written approval of the Minister, following mandatory consultation with the trade union and employer's organisation involved, to lay-off or retrench an employee or to impose work on a short-time basis. Violations are subject to a fine or imprisonment. In terms of s. 135 of the Act, S.I. 370 limits the amount a private employment agency may legally charge to work-seekers, employers and other clients. The Regulations impose conditions for an agent to make a referral and require record-keeping. S.I. 372, issued under s. 26 of the Act, defines "works council", half of whose members are to be employee representatives who are members of a workers' committee. A workers' committee is to be formed when employees select their representative at their workplace. It must have between 3 and 15 members who are representative of the different sections of the undertaking. The Regulations govern its officers, tenure of office and procedures for meetings. Finally, S.I. 369 regulates proceedings before the Labour Relations Tribunal which was created by s. 141 of the Act.

The regulations cover, inter alia, the registration of workers' and employers organisations, the functioning of the employment councils, the settlement of disputes and unfair labour practices, collective job action and the procedure to be followed by the Labour Relations Board.
