Other provisions cover membership, shares and annual subscription, investment of funds, annual general meetings, the National Board of Directors, State division and Committees, by-laws, accounts, appointment and employees, insurance, banking, audit, application of funds and winding up.

    General provisions cover the definition of cooperatives, membership, and shares. It sets forth the establishment of cooperative societies, which include by-laws and registration. Sets up the General Assembly who consists of all members of the Society. Specifies that each Society shall have a Management Committee to follow up the preparation of reports and final accounts, and a supervisory Committee to control the functioning of the society's operations, by-laws and decisions of the General Meeting. Provisions are made for the distribution of surplus and the reserve fund. The Ministry of Labour and Social Affairs has the right to supervise all kinds of cooperatives through its inpectors as for example to stop the execution of any cooperative decision if it is against the cooperative law or cooperative principles. It finally deals with Secondary Societies, Cooperative Unions, as well as the liquidation and cancellation of cooperative societies.

    This ordinance, repealing the Society Act of 1940, regulates the settlement and management of cooperatives. It sets forth the procedure and criteria for registration. The management of cooperative societies shall vest in a managing committee whose members are elected by the General Assembly. Restricts the possibility for cooperatives to receive deposits and loans from persons who are not members of cooperatives. Provides for the privileges of cooperatives societies as for example the possibility to change their form and liability. Other provisions cover the property and funds of cooperative societies, distribution of profits, privileges, liabilities and obligations of members of cooperative societies, audit, inspection and inquiry, settlement of disputes, winding up and dissolution of cooperative societies. An entire chapter deals with special provisionss for cooperative land mortgage banks, central societies and national societies. Provisions are made for the enforcement of obligations and the recovery of sums due. Regulates jurisdiction and appeal, offences, penalties and procedure.

Conditions for registration include a membership of at least ten persons, other than corporate bodies, who have attained the age of sixteen years, and detailed provisions for the names of societies. Under the Act, a registered society is a body corporate governed by its own by-laws. Other provisions cover share capital, issue of shares, allocation of surplus, dividends, prohibited loans and guarantees in the event of insolvency, the office of directors, meetings, voting, membership and suspension or termination thereof, financial matters and audit, dissolution and liquidation, settlement of disputes, the establishment of a Co-operative Societies Appeals Tribunal, civil remedies, the functions of the Registrar, consumers' societies, and other matters. The former Co-operative Societies Act is repealed (Cap. 378).

Précise que chaque coopérative ne peut être agréée qu'en qualité d'organisme compétent pour participer à la formation de celles des commissions dont la nature correspond à son activité la plus importante. Réglemente la radiation d'un groupement ou d'une société coopérative agréée.

Sets up the election of a Committee which shall represent cooperatives before all competent public authorities. Members who desire to obtain a secured loan shall submit an application to the committee which may approve it. Obliges every member of a registered society to deliver to it such amount of article produced or obtained by him, to be disposed of by the registered society.     La citada ley modifica la Disposición Transitoria Primera de la Ley núm. 356, de 11 de abril de 2013, General de Cooperativas, imponiendo a las cooperativas que se encuentren registradas y en funcionamiento la obligación de adecuarse a las disposiciones de dicha ley antes del 13 de mayo de 2018, bajo apercibimiento de cancelarse las autorizaciones no ratificadas y ordenarse la disolución, liquidación y extinción de tales cooperativas. Asimismo, incorpora una Disposición Final única, en la que se ratifica el respeto en las cooperativas de los derechos sindicales, laborales y de asociados de los sindicatos que incluyan asociadas y asociados pre-existentes a la promulgación de dicha Ley, así como de los que fueren a constituirse a futuro en los sectores de Servicios y Servicios Públicos.
