In shift work, the normal working time can be extended up to 12 hours, as long as an average of 40 hours a week is maintained. S. 5 provides that works agreements or enterprises not subject to a collective agreement may extend normal working time to 60 hours a week in the case of "on call" workers (Arbeitsbereitschaft). Also provides for overtime pay, maximum hours of work, rest periods for truck drivers, and the use of working time credit systems, whereby workers can save up extra hours of work.

During the leave, the employment relationship remains intact, as paternity leave is to be considered as an extended holiday. The leave may commence at the end of the mother's prohibition to work (usually 8 weeks after birth) and is limited to the end of the child's second year of life. Paternity leave may only be taken by fathers residing in the same household as the child. Employees on such leave may not be dismissed during the period of their leave.

Federal Act of 25 November 1987 amending the Construction Workers' Leave Act [BGBl. 414/1972], the Workers' Termination Act [BGBl. 107/1979] and the Insolvency (Wage Guarantee) Act [LS 1977 - Aus. 1]. Text No. 618. Adoption: 1987-11-25 | AUT-1987-L-4484 This Act changes the title of the 1972 Act to the Construction Workers' Leave and Termination Act. It introduces a new Division III, entitled Conditions of Termination (ss. 13a-13h), which governs rights to severance pay in various cases. The amount of severance pay ranges from two months' wages for a worker who has completed 156 weeks of employment to twelve months' wages for a worker having worked over 1300 weeks (s. 13d). The Act also amends sections dealing with administration of the Leave and Severance Pay Fund and its financing and makes miscellaneous conforming amendments. A new subsection (3) is added to s. 2 of the Workers' Termination Act of 1979 in regard to calculating continuous service. The Insolvency (Wage Guarantee) Act is amended to provide, inter alia, that employers are to pay a supplement; when it has been paid, no claim to severance pay can be made in case of insolvency (amendment of s. 12(1)(Z) and addition of subs. Z5 to s. 1(3)). With the exceptions detailed in Part V of this Act, the amendments entered into force 1 Oct. 1987.

Adds new subsections (5) and (6) to s. 15 calling for driving breaks every two hours and falling within working hours. New s. 26a deals with recordkeeping in relation to time spent at the wheel.

Also sets out employee's right to take extra paid leave in the event that the employee must look after persons in need of care living with him or her in the same household, or if the employee must care for the children due to the absence of the regular caretaker.
