Decreto núm. 2066, de 23 de octubre de 2015, que regula el Cestaticket Socialista para los Trabajadores y Trabajadoras - Adoption: 2015-10-23 | Date of entry into force: 2015-10-23 | VEN-2015-R-103828 El citado decreto regula el Cestaticket Socialista, como beneficio de alimentación para proteger y defender la capacidad adquisitiva de los trabajadores y las trabajadoras en materia alimentaria, a fin de fortalecer su salud, prevenir las enfermedades ocupacionales y propender a una mayor productividad laboral. En tal sentido, impone a las entidades de trabajo del sector público y del sector privado la obligación de otorgar a los trabajadores y las trabajadoras el beneficio de una comida balanceada durante la jornada de trabajo, denominada “Cestaticket Socialista”. Define el concepto de comida balanceada, establece las modalidades de su prestación y prohíbe su pago en dinero en efectivo o su equivalente, ni por otro medio que desvirtúe su propósito, salvo el caso de sustitución temporal de la modalidad de otorgamiento mientras el trabajador o trabajadora se encuentre disfrutando de su derecho a vacaciones, descanso pre y postnatal, permiso o licencia de paternidad o en caso de incapacidad por enfermedad o accidente que no exceda de doce (12) meses, para cuyo caso se establece su monto mínimo. Dicta disposiciones relativas a los establecimientos especializados en la administración y gestión de beneficios sociales que emitan y administren cupones, tickets o tarjetas electrónicas de alimentación, dispone las especificaciones que deberán contener los cupones, tickets y tarjetas electrónicas y establece sanciones.

Asimismo dispone los salarios mínimos especiales de los trabajadores de empresas que tengan un número menor de 20 trabajadores, de los adolescentes trabajadores y aprendices y de los trabajadores rurales.
Fija también los montos mínimos de las pensiones de jubilados y pensionados de la Administración Pública Nacional así como las otorgadas por el Instituto Venezolano de Seguros Sociales.
Por último, prescribe que cuando la relación de trabajo se hubiera convenido a tiempo parcial, el salario estipulado como mínimo puede someterse a lo dispuesto en el artículo 194 de la Ley Orgánica de Trabajo, en cuanto fuera pertinente.

Adoption: 1997-12-30 | VEN-1997-R-49294 La Comisión Tripartita Nacional a que se refieren los artículos 167 y siguientes de la Ley Orgánica del Trabajo estará integrada en forma paritaria por: 1) el Ejecutivo Nacional por órgano de los Ministerios de Industria y Comercio y del Trabajo, así como de la Oficina Central de Coordinación y Planificación de la Presidencia de la República, 2) la organización sindical de trabajadores más representativa y 3) la organización más representativa de empleadores. Se constituye una Comisión Técnica Tripartita, de integración paritaria, que tendrá como sede el Ministerio del Trabajo y cuya función primordial consistirá en servir de secretariado permanente e instancia de asesoría técnica a la Comisión Tripartita. Si vencido el lapso de treinta días hábiles a partir de la instalación de la Comisión no se adoptare recomendación alguna sobre la revisión de salarios mínimos, el Ejecutivo Nacional podrá acudir a la modalidad prevista en el art. 172 de la ley Orgánica del trabajo.
