    Ministerial Order No. 3 of 2008 with respect to designating businesses and administrative authorities in which a convict may be employed by virtue of an order of the punishment execution judge and the regulations of such employment.

    Article 1 - Definitions of "trafficking in persons", "exploitation" and explains offences relating to victims under the age of 18 years.
    Article 2 - provides for penalties for persons who commit an offence under the law of imprisonment and a fine as well as being liable to pay the costs, including repatriation, following conviction of an offence. The property and funds etc. may also be confiscated by the State.

    Article 4 - Lists the aggravating circumstances to the crime of trafficking (subject to the provisions of Chapter 5, Part 3 of the Penal Code)

    NOTE: Act has been passed in Parliament but is waiting to be approved and to come into force (21/09/2016).

    The Act repeals the Transnational Organized Crime (Prevention and Control) Act, 2011 (Act 2011-3) in order to make fuller provision for the prevention of the trafficking in persons and the implementation of the United Nations Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention Against Transnational Organized Crime.

    The Act broadens the scope of the offences by creating an offence where trafficking in persons takes place within the country and creates a special offence with heavier penalties in relation to the trafficking of children.

    Estipula que la inclusión del nombre del infractor en el registro se realizará después de la decisión administrativa final relativa al auto de la infracción redactado a consencuencia de la acción fiscal en que haya existido una identificación de trabajadores sometidos a condiciones análogas a la de esclavo.
    El registro se actualizará semestralmente. La inspección del trabajo realizará un monitoreo por un período de dos años a contar de la fecha de inclusión del nombre del infractor en el registro. A partir de ese momento y no habiendo reincidencia, se excluye el nombre del infractor del registro.

    Instituye, en el ámbito del Ministerio de Justicia, el Grupo de Trabajo Interministerial con la finalidad de elaborar la propuesta de la PNETP.
    En su anexo establece que la citada PNETP tiene por finalidad establecer principios, directrices y acciones de prevención y represión al tráfico de personas y de atención a las víctimas.

    Ordenanza núm. 540 de 15 de octubre de 2004 de creación en el ámbito del Ministerio de Trabajo y Empleo del Registro de Empleadores que hayan mantenido trabajadores en condiciones análogas a la de esclavo. - Ministério do Trabalho e Emprego

    Estipula que la inclusión del nombre del infractor en el registro ocurrirá después de la decisión administrativa final relativa al auto de infracción levantado a consecuencia de una acción fiscal en que haya existido identificación de trabajadores sometidos a condiciones análogas a la de esclavo.

    Ley núm. 10803, de 11 de diciembre de 2003, que modifica el decreto-ley núm. 2848 de 7 de diciembre de 1940 que dicta el Código Penal. (Lei N° 10803, de 11 dezembro de 2003: Altera o Decreto-Lei N° 2848, de 7 de dezembro de 1940- Código Penal.) - Presidência da República

    Modifica el artículo 149 del citado decreto con el fin de establecer las hipótesis en que se configura la condición de esclavo y las sanciones correspondientes al delito consistente en reducir a una persona a dicha condición. Establece la pena de prisión de dos a ocho años, así comoo una multa, a las personas que mantengan a los trabajadores en condiciones análogas a las de esclavitud en sus propiedades.

    Ley núm. 10608, de 20 de diciembre de 2002, que modifica la Ley núm. 7998, de 11 de enero de 1990, que regula el programa del seguro de desempleo. - Presiência da República

    Asegura el pago del seguro de desempleo al trabajador comprobadamente rescatado del régimen de trabajo forzoso o de la condición análoga a la de esclavo.
