La demarcación de las tierras será precedida por su identificación, a cargo de un grupo técnico designado por el órgano federal de asistencia al indígena. El grupo indígena involucrado participará en el proceso en todas sus fases. Otros órganos públicos, miembros de comunidades científicas o especialistas, también podrán participar, a propuesta del grupo técnico. Podrán considerarse los trabajos de identificación y de delimitación realizados anteriormente, a los fines de demarcación. Aprobado el informe del grupo tècnico por el titular del órgano federal de asistencia al indígena, éste lo hará publicar en el Diario Oficial y lo pasará al Ministerio de Justicia para su aprobación definitiva. El órgano federal de asistencia al indígena procederá, en el plazo de un año, a la revisión de las tierras indígenas consideradas insuficientes para la sobrevivencia física y cultural de los grupos indígenas. El Ministerio de Justicia, a solicitud del titular del órgano federal de asistencia al indígena, podrá decidir la interdición provisoria de las tierras en que se compruebe la presencia de indígenas aislados o de otras en que la interdicción se haga necesaria, para preservar la integridad de los indígenas y de los respectivos territorios.

5 The purposes of this Act are to

(a) support and promote the use of Indigenous languages, including Indigenous sign languages;

(b) support the efforts of Indigenous peoples to reclaim, revitalize, maintain and strengthen Indigenous languages, including their efforts to

(i) assess the status of distinct Indigenous languages,

(ii) plan initiatives and activities for restoring and maintaining fluency in Indigenous languages,

(iii) create technological tools, educational materials and permanent records of Indigenous languages, including audio and video recordings of fluent speakers of the languages and written materials such as dictionaries, lexicons and grammars of the languages, for the purposes of, among other things, the maintenance and transmission of the languages,

(iv) support Indigenous language learning and cultural activities — including language nest, mentorship and immersion programs — to increase the number of new speakers of Indigenous languages,

(v) support entities specialized in Indigenous languages, and

(vi) undertake research or studies in respect of Indigenous languages;

(c) establish a framework to facilitate the effective exercise of the rights of Indigenous peoples that relate to Indigenous languages, including by way of agreements or arrangements referred to in sections 8 and 9;

(d) establish measures to facilitate the provision of adequate, sustainable and long-term funding for the reclamation, revitalization, maintenance and strengthening of Indigenous languages;

(e) facilitate cooperation with provincial and territorial governments, Indigenous governments and other Indigenous governing bodies, Indigenous organizations and other entities in a manner consistent with the rights of Indigenous peoples and the powers and jurisdictions of Indigenous governing bodies and of the provinces and territories;

(e.1) facilitate meaningful opportunities for Indigenous governments and other Indigenous governing bodies and Indigenous organizations to collaborate in policy development related to the implementation of this Act;

(f) respond to the Truth and Reconciliation Commission of Canada’s Calls to Action numbers 13 to 15; and

(g) contribute to the implementation of the United Nations Declaration on the Rights of Indigenous Peoples as it relates to Indigenous languages.

This enactment establishes a regime, alternative to the one under the Indian Act, to govern the election of chiefs and councillors of certain First Nations.
Among other things, the regime
(a) provides that chiefs and councillors hold office for four years;
(b) provides that the election of a chief or councillor may be contested before a competent court; and
(c) sets out offences and penalties in relation to the election of a chief or councillor.
This enactment also allows First Nations to withdraw from the regime by adopting a written code that sets out the rules regarding the election of the members of their council.

This enactment provides a new entitlement to Indian registration in response to the decision in McIvor v. Canada (Registrar of Indian and Northern Affairs) that was issued by the Court of Appeal for British Columbia on April 6, 2009.

The case found that it was unconstitutional to allow registration of a person as an Indian based on paternal and excluding maternal descent. The Indian Act is modified to allow for registration under both the maternal and paternal lines.
