Part I applies to non-British ships anchored in UK ports. Inter alia, it provides for the Marine Safety Agency to inspect at least 25 per cent of such ships, and in cases of non-compliance, provides powers of further inspection and detention. Part II concerns rights and appeals in respect of Part I. Part III implements Chapter XI of the SOLAS Convention, allowing inspection of the familiarity of the crew with essential procedures and operations relating to the safety of the ship.

    Governs any arrangements that may be made for the provision by contractors of certain dockyard services. It declares the Transfer of Undertakings (Protection of Employment Regulations 1981) applicable to dockyard undertakings, subject to special conditions (section 1(4)). Under the Act, representatives of independent recognised trade unions shall be informed of the transfer, its legal, economic and social implications for the employees, and any measures envisaged to be taken on their behalf by the employer and/or the Secretary of State. If the Secretary envisages taking measures, consultations with trade union representatives shall take place (section 1(8)). The trade union may bring court action alleging the Secretary's failure to fulfil his duty in this regard (section 2). Other miscellaneous provisions.

Also regulates specialized longshoring operations such as containerized cargo, logging, and roll-on/roll off.

    Extends the scope of application of the Hazard Communication Standard (20 CFR Part 1910.1200, published in the Federal Register of 25 Nov. 1983, p. 53280 et seq.), issued by the Occupational Safety and Health Administration, to non-manufacturing employers (e.g. in shipyard employment, longshoring, construction, agriculture). Henceforth both manufacturing and non-manufacturing employers are required to establish hazard communication programmes to transmit information on the hazards of chemicals to their employees by means of labels on containers, safety data sheets showing the composition of materials and training programmes.

Repeals section 45, 46 and 47. Section 6(b)(1) is amended to provide that compensation payments for death shall be limited to a maximum of 200 per cent of National Average Weekly Wage applicable on the date of death. Previous amendment to the Act: 1972.
