    Se agrega como art. 103 bis el siguiente: "Beneficios sociales. Se denominan beneficios sociales a las prestaciones de naturaleza jurídica de seguridad social, no remunerativas, no dinerarias, no acumulables ni sustituíbles en dinero, que brinda el empleador al trabajador por sí o por medio de terceros, que tiene como objeto mejorar la calidad de vida del dependiente o de su familia a cargo". A continuación se enumeran las prestaciones que deben considerarse beneficios sociales. El art. 105 se leerá: "Forma de pago. Prestaciones complementarias. El salario debe ser satisfecho en dinero, especie, habitación, alimentos, o mediante la oportunidad de obtener beneficios o ganancias. Las prestaciones complementarias, sean en dinero o en especie, integran la remuneración del trabajador." Se determinan las excepciones. Se agrega el artículo 223 bis: "Se considerará prestación no remunerativa las asignaciones en dinero que se entreguen en compensación por suspensiones de la prestación laboral y que se fundaren en las causales de falta o disminución de trabajo, no imputales al empleador, o fuerza mayor debidamente comprobada, pactadas individual o colectivamente...". Se establece una contribución del 14 por ciento sobre los vales alimentarios o cajas de alimentos y sobre los pagos de servicios médicos de asistencia o previsión. Esta contribución se encontrará a cargo del empleador y se destinará al financiamento del sistema de asignaciones familiares.

    Los empleadores que a la fecha de vigencia del decreto núm. 773/96 venían otorgando vales alimentarios o cajas de alimentos a sus dependientes, están obligados a mantenerlos, pudiendo sustituirlos por su equivalente en dinero, y debiendo efectuar sobre ellos las retenciones en concepto de aportes y las contribuciones con destino al Sistema Unico de la Seguridad Social. En los considerandos se indica que el decreto núm. 773/96 derogó el decreto núm. 1477/89 que incorporaba el beneficio de la canasta familiar, y que conviene dejar definitivamente aclarado que el propósito de tal derogación fue la de asignar a los vales de alimentos el carácter de remuneración en especie a los fines contributivos, sin suprimir las ventajas que su dación implica.

    Entre los considerandos se dice que "los organismos que controlan el cumplimiento de los Convenios y Recomendaciones adoptadas por la Organización Intenracional del Trabajo se han ocupado especialmente del tema, en relación con el Convenio núm. 95 y estimaron que tales beneficios deberían estar incluidos en la remuneración del trabajador en concordancia con lo dispuesto en el artículo 1 de la mencionada norma internacional del trabajo, ratificada" en 1956. El propósito del decreto núm. 773/96 no es el de eliminar la percepción de las cajas de alimentos o vales alimentarios sino el de asignarles el carácter de remuneración en especie con todas las consecuencias que prevén las normas laborales y de seguridad social.

    Under amended s.10(1) of the Unemployment Insurance Act, an unemployed person who refuses employment or training is deprived of unemployment benefits for at least four weeks after the refusal (or six or eight weeks in the case of a second and third refusal during a one-year period). The amendments also revise the prerequisites for initial entitlement to benefits (s.14), the maximum number of weeks of benefits (s.18) and the reckoning of time spent on involuntarily reduced hours, maternity leave or training (s.21). The amendment Act sets forth new benefit tables and amends provisions concerning benefits available under other social insurance schemes and the treatment of spouse's earnings. New provisions specify rights of unemployed persons who have contributed to schemes in countries covered by a bilateral agreement with Austria on unemployment insurance.
