Résumé/Citation: The Regulations prescribe the criteria and methodology for assessing work of equal value contemplated in section 6(4) of the Employment Equity Act which was amended by Act No. 47 of 2013. It sets out the obligations of employers with respect to ensuring that unfair discrimination, including wage discrimination, is eliminated in the workplace with respect to work of equal value including but not limited to eliminating wage discrimination based on race, gender or disability. The regulations define what is meant by work of equal value and also provide factors which may justify differentiation in terms of employment conditions. In order to ensure that the regulations are implemented, there are a number of obligations that employers must comply with including the drafting and implementation of an Employment Equity Plan, as provided for in the Act, as well as reporting obligations to the competent authorities. Enforcement is undertaken through the issuing of written undertakings and compliance orders by the Labour Inspectors or the Director-General Review Process.
