This Act, wholly amended in 1992, regulate in detail the conditions for entry to and exit from Korea. All persons (including nationals) leaving and entering shall undergo exit or entry inspections. On certain conditions, any person (including nationals) may be prohibited to leave Korea. An entering foreigner is required to have a valid passport, a visa and a residence permit. The Minister of Justice may decide to require a guarantee to be furnished by the invitor of the foreigner. Residence permits are granted for different periods of time and a foreigner may work in Korea only if the residence permit so specifies. Foreigners remaining in Korea for more than 90 days are required to file a residence report and to register with the proper authority. The Act regulates when and on what conditions foreigners may be deported. Objections to deportation orders are handled and decided by the Minister of Justice. Violations against the Act are criminally sanctioned.
