International labour law is a highly valuable resource for domestic judges and lawyers seeking to settle labour disputes. Together with the comments and analysis of the relevant ILO supervisory bodies, ILS offer a matchless source of interpretation and inspiration for judges and lawyers in ILO member States. Several examples show that domestic courts are increasingly more willing to draw not only on international labour Conventions and Recommendations but also on the work of the ILO supervisory bodies to interpret and complement their domestic law.

The ITCILO and the ILO Project “ILS Compliance and Reporting: Trade for Decent Work Project”, in collaboration with the Mongolian Bar Association, are accordingly offering advanced training to law professionals in Mongolia to enable them to make full use of the sources of international labour law in their daily practice.

PARTICIPANTS’ PROFILE

The course is intended for 36 law professionals among:

• judges from courts and tribunals that dal with labour litigation;
• prosecutors;
• labour lawyers and attorneys;
• legal experts who represent the interests of employers’ or workers’ organizations;
• civil servants who work at the Ministry of Labour and Social Protection and National Human Rights Commission;
• university law teachers.

OBJECTIVES

For participants to gain:

• in-depth knowledge of the instruments and supervisory machinery of the ILS system;
• capability to determine in which instances domestic judges and lawyers can use international labour law to solve labour disputes;
• ability to use the analysis and pronouncements of the ILO supervisory bodies; and
• capacity to identify and make use of ILS in key areas.

TOPICS COVERED

• Recap on: the ILS system and its procedures, from international drafting to national application; when and how domestic judges can use international labour law; and the work of the ILO supervisory bodies and its relevance to judges and lawyers.
• Substance of ILS in selected areas and their relevance to judges and lawyers.

The content is based on:

• the premise that participants are already versed in legal concepts and thinking; and
• prior participation in the courses “Continuing Legal Education on International Labour Standards (CLE on ILS)”.

METHODOLOGY

The course will combine asynchronous and synchronous activities:

• knowledge assessment at the start and at the end of the training; an introductory and final self-guide sessions;
• live sessions via Zoom for five consecutive weeks (2 consecutive sessions each week), combining presentations with practical exercises and demonstrations;
• preliminary questions, videos and other resources to be explored.

All live sessions will be recorded for asynchronous view after the course. The recordings will be uploaded to the e-Campus.

PREPARATORY PHASE

In preparation for the course, the week before its start participants will be asked to go through the three self-guided courses “Continuing Legal Education on International Labour Standards (CLE on ILS)”.

CERTIFICATE OF PARTICIPATION

On completing the course, participants will be entitled to the digital credential on “International labour standards for law professionals (Mongolia)” issued by the ITCILO.

FOLLOW-UP

All participants will be invited to join the on-line Community of Practice on “International labour standards for judges, lawyers and legal educators”, a network of law professionals who have attended this type of ITCILO courses.
